IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.12244 of 2025
Ashirbad Pradhan … Petitioner
Mr. B.P. Tripathy, Sr. Advocate along with Mr. P. Agrawal, Advocate -versus- State of Odisha … Opposite Party Mr. P. Satpathy, Addl. PP
CORAM: JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) 07.03.2026
03.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Banpur PS Case No.54 of 2023 corresponding to ST Case No.98 of 2023 (GR Case No.58 of 2023) pending in the file of learned 1st Additional Sessions Judge, Khordha, for commission of offences punishable U/Ss.364-A/364/ 302/201 of IPC, on the main allegation of abducting the victim for a ransom of Rs.5,00,000/- and committing his murder.
3. Heard, Mr. Bibhu Prasad Tripathy, learned Senior Counsel, who is being assisted by Mr. Partha Agrawal, learned counsel for the petitioner and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record including the copy of depositions of PWs.1 to 25 as supplied.
4. After having considered the rival submissions upon perusal of record, there appears allegation against
the petitioner for abducting the deceased for ransom and committing his murder, but the trial has right now progressed substantially with examination of 25 witnesses. It is no doubt advanced by the learned Senior Counsel that none of the witnesses have specifically deposed against the petitioner, but law is fairly well settled that detailed analysis of evidence and meticulous examination of documents on merit should be avoided at the stage of consideration of bail. In that view of the matter and taking into account the progress of trial in this case and there being allegation against the petitioner for abducting the deceased for ransom and committing his murder and regard being had to the materials placed on record including the recovery of the dead body allegedly from the well located in the premises of house of the petitioner and keeping in view the law laid down by the Apex Court in X Vrs. State of Rajasthan (2024) SCC Online SC 3539, this Court is not inclined to grant bail to the petitioner.
5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A copy of this order be immediately transmitted to the learned Court in seisin over the matter.
