1. Heard learned counsel for the petitioners and learned A.G.A. for the State. 2. The present petition under Article 227 of the Constitution of India has been filed assailing the order dated 03.01.2025 passed by the learned Additional Sessions Judge, Fast Track Court No. 2, Mathura in Criminal Revision No. 361 of 2023 (Babu Lal and Another v. State of U.P.), as well as the order dated 14.07.2023 passed by the learned Civil Judge (Junior Division)/Judicial Magistrate, Chhata, District Mathura in Case Crime No. 418 of 2017 (State v. Babu Lal and Another). 3. The brief facts giving rise to the present petition are that the petitioners are alleged to have taken a sum of Rs. 1,50,000/- from the complainant with an assurance of securing employment for the complainant's son as a Safai Karmachari. However, the alleged promise was not fulfilled. Upon demand of refund by the complainant, the petitioners are said to have returned Rs. 20,000/- and assured to repay the remaining amount of Rs. 1,20,000/-, which was never paid. On the said allegations, the aforesaid case crime was registered against the petitioners. 4. Learned counsel for the petitioners submits that the petitioners are poor persons earning their livelihood through small private jobs. It is contended that the complainant and his family members are notorious and involved in unlawful activities, and that the entire prosecution story is false and fabricated. It is further urged that the Investigating Officer has recorded statements of only interested witnesses and has not examined any independent witness. The charge-sheet, according to the learned counsel, has been filed in a mechanical and casual manner. 5. Having heard learned counsel for the parties and upon perusal of the record, this Court finds that all the submissions made on behalf of the petitioners relate to disputed questions of fact, which cannot be adjudicated Versus Counsel for Petitioner(s) : Dhirendra Kumar Agrahari Counsel for Respondent(s) : G.A.
