HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22580 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J. HON'BLE SANJIV KUMAR, J. We have heard Mr. Sanjay Singh, learned counsel for the petitioners at great length and Mr. Anil Kumar Mishra, learned AGA on behalf of the State. There are cross-versions about the occurrence dated 19.07.2019 that is to say, the one carried in impugned FIR lodged by the first informant- respondent and the other by petitioner no.4, Asha Tiwari against Alok Rai, the informant's husband. On the petitioners side, the injuries have been sustained by two, that is to say, Angad Tiwari and other by Asha Tiwari, whereas on the informant's side, the informant Priti Rai and her mother-in- law Ram Raji Devi have sustained injuries. The police papers show that Ram Raji Devi has sustained a fracture. Considering that both sides have sustained injuries and it is a case of free fight, it is difficult for this Court to examine the issue, which side were the aggressors. This is a matter which requires investigation and may be a final determination at the trial. No case for quashing the impugned FIR is made out. The writ petition is summarily dismissed.
