HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34706 of 2025
Court No. - 4 HON'BLE AJIT KUMAR, J.
HON'BLE SWARUPAMA CHATURVEDI, J.
1. Heard Sri Pradeep Kumar, learned counsel for the petitioner as well as Sri Purnendu Kumar Singh, learned panel counsel appearing for respondent nos. 1 to 3.
2. By means of this writ petition filed under Article 226 of the Constitution, petitioner seeks a writ in the nature of mandamus to command respondent authority-Regional Passport Officer to issue passport of the petitioner for which he moves an application on prescribed format on 11.09.2025.
3. On pointed query being made, learned counsel appearing for petitioner could not demonstrate as to whether he has received any mail from Regional Passport Officer seeking any clarification.
4. In the circumstances, merely for the reason that petitioner has a criminal antecedent and is apprehensive of his application being rejected, a writ of mandamus cannot be issued at this stage. Petitioner should have waited for the notice from Regional Passport Officer to reply, however, in the meanwhile, it is always open for the petitioner to get no objection from the concerned criminal law court, if he is so advised.
5. Subject to what we have observed above, this petition is consigned to records as premature at this stage.
