For the Respondent: Mr. Vishwajeet Singh, Advocate. ------------------------------------------------------------------------------------ Jyotsna Rewal Dua, Judge Following order was passed in this matter on 09.07.2025:- “Learned counsel for the parties have apprised that Letters Patent Appeal (LPA) No.348 of 2025 instituted by the respondent against the judgment rendered on 04.06.2025 in CWP No.13366 of 2024 (Kuldeep Thakur Versus Secretary Himachal Pradesh Rajya Chayan Ayog) was dismissed on 07.07.2025. 2. Learned counsel for the petitioner expresses an apprehension that even though respondent’s appeal has been dismissed, yet, it has made recommendations for appointment of next 13 candidates from the waiting panel prepared on the basis of same recruitment process, in which the petitioner has now emerged meritorious on merits. That without considering the case of the petitioner and without making recommendations for his appointment in order of merit, the candidates 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 appearing in the waiting panel cannot be offered appointments. 3. Learned counsel for the respondent assures that in view of dismissal of LPA No.348 of 2025 and in light of the decision rendered in CWP No.13366 of 2024, name of the petitioner shall be recommended by the respondent in order of his merit as a candidate appearing in the main select list for his appointment. He prays for and is allowed two days’ time to place on record the requisite instructions for recommending the name of the petitioner. List on 11.07.2025.” 2. Learned counsel for the respondent has placed on record office instructions dated 10.07.2025 from the Secretary, H.P. Rajya Chayan Aayog, Hamirpur to the effect that the petitioner would now be recommended for appointment under the Unreserved category in view of his emerging at Sr. No.978 in the overall merit list/main selection list in the recruitment process in question. That the petitioner would be recommended for appointment as such against the post of Junior Office Assistant (IT) in Himachal Pradesh State Civil Supplies Corporation Limited, where the vacancy has been kept vacant for the petitioner in view of the orders passed in CWP No.13366 of 2024. That necessary action and appropriate orders would be issued within next two working days, i.e. by 15.07.2025. 3 3. Learned counsel for the petitioner submits that office instructions dated 10.07.2025 redress the grievance of the petitioner. In view of office instructions dated 10.07.2025 and the submissions made by learned counsel for the parties, this writ petition is disposed of with direction to the respondent to recommend the name of the petitioner for appointment against the vacant post of Junior Office Assistant (IT) in H.P. State Civil Supplies Corporation Limited by 15.07.2025, to enable the concerned Corporation/Department to take follow up action. Pending miscellaneous application(s), if any, also stand disposed of.
