The learned counsel appearing on behalf of the petitioner submits that by virtue of the judgment and order dated 12.09.2024 passed in WP(C) No.5069/2016, the writ petition was dismissed thereby the award dated 30.10.2015 passed by the Central Government Industrial Tribunal-cum-Labour Court, Guwahati in Reference Case No.5/2011 has been confirmed. He therefore submits that the petitioner would be well advised to initiate action under Section 17A of the Industrial Disputes Act, 1947 rather than proceeding with the instant proceedings. 3. Taking into account the above, this Court is not inclined to entertain the instant application. 4. However, liberty is given to the petitioner to proceed under Section 17A of the Industrial Disputes Act, 1947 for enforcement of the award. 5. It is further observed that the petitioner shall also be at liberty to resort to other remedies for enforcement of the award as permissible under law. JUDGE Comparing Assistant
