Heard Sri Nagendra Kumar Tripathi, learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for following relief:- "1. Issue a writ order or direction in the nature of mandamus, commanding the respondent no. 2 & 3 to restrain the respondent no. 4 to 7 from grabbing the property of the petitioner i.e. 3/4 share of Gata No. 665 area 0.186 hectare and Gata No. 594 area 0.304 hectare/Khata No. 317 (total area 0.490 hectare) situated at Village Dadhiyal, Tehsil Hasanpur, District Amroha." 3. In our considered view the relief is in the nature of injunction arising out of pure civil dispute which may involve disputed questions of fact and hence, petitioner may avail the remedy of civil suit, if so advised. Accordingly, we decline to grant indulgence in the matter. 4. Subject to aforesaid liberty this petition is consigned to records.
