ORDER 19.09.2025 Heard Mr. S. Munir, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State.
2. This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely,
Page No.# 2/3 Sailen Kr. Saikia, has prayed for bail in connection with Jalukbari P.S. Case No. 381/2025 registered under Section 75(1)(i)(ii) of the BNS, 2023.
3. The allegation in the F.I.R. dated 05.09.2025 lodged by the alleged victim herself is that the accused who is the owner of the concern where she works as an Accountant misbehaved with her and committed sexual assault and molestation upon her.
4. The accused was arrested on 05.09.2025 and presently in custody. It is submitted by the prosecution that upon completion of investigation, the case has been charge-sheeted against the accused. Perused the scanned copy thereof. It is submitted by the prosecution that in the scanned copy of the record there are no materials in support of the contention of the petitioner side that the informant after losing her job in the concern of the accused, lodged the instant F.I.R. vindictively.
5. In view of the completion of the investigation, it is hereby directed that the accused-petitioner, named above, shall be released on bail in connection with Jalukbari P.S. Case No. 381/2025 registered under Section 75(1)(i)(ii) of the BNS, 2023, on furnishing bail bond of Rs.30,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court (learned CJM, Kamrup(M).
6. The direction for bail is further subject to the following conditions: (a) That the petitioner shall be available for trial; (b) That the petitioner shall not hamper or tamper with evidence; and (c) That the petitioner shall not intimidate or harass the informant/victim side, in any manner.

7. Violation or breach of any condition(s) shall entail cancellation of bail.
8. With the above observations, this bail petition stands allowed and
disposed of accordingly.
