Heard Sri Shobhnath Singh Yadav, learned counsel for the petitioner, Sri Vijay Pratap Singh, learned Additional Chief Standing Counsel appearing for the State respondents and Sri Bhupendra Kumar Tripathi, learned counsel representing the respondent-Gram Sabha. The present petition has been filed seeking a direction to the respondent no.4, the Sub Divisional Officer, Tehsil Kakhaniya, District Ghazipur, not to construct the Pathway upon land bearing Plot No. 392m, area 0.101 hectare, situate in Village Bairampur, Paragana Shadiyabad, Tehsil Jakhaniya, District Ghazipur. The aforesaid relief which is being sought is in the nature of an injunction. Moreover, the petitioner has already preferred a suit being Original Suit No. 418 of 2020, in respect of the same land parcel, wherein it is stated that there exists an order of status quo. In that view of the matter, the present writ petition would not be entertainable. Accordingly, counsel for the petitioner states that he does not wish to press the petition and that the petitioner would pursue his legal remedy in the pending suit.
