The present Interlocutory Application has been instituted praying for condonation of delay of 1168 days in filing the connected criminal revision petition. Mr. N K Kalita, learned counsel for the applicant has taken this Court through the contentions raised in the present Interlocutory Application and has submitted that the delay occasioning in the matter was on account of factors beyond his control. He, accordingly, submits that the present Page No.# 3/3 application be allowed, condoning the delay in filing the connected criminal revision petition. Mr. M K Das, learned counsel for the respondent No. 2 has fairly submitted that this Court may take up the criminal revision petition for consideration on its merit, by condoning the delay occasioning in filing the same. He submits that he would have no objection in allowing the present Interlocutory Application. In view of the submissions made by the learned counsel for the parties, this Court is of the considered view that the delay occasioning in filing the connected criminal revision petition by the petitioner, herein, would call to be condoned. Accordingly, the delay of 1168 days in filing the connected criminal revision petition stands condoned. Accordingly, the present Interlocutory Application stands allowed. JUDGE Comparing Assistant
