JUSTICE BISWAJIT PALIT Order 07/10/2025 This pre-arrest bail application is filed under Section 482 of BNS for granting bail to the petitioner accused Sri Ranjan Saha in connection with West Agartala P.S. Case No.2025 WAG 017 under Section 318(4)/316(5) of BNS Act, 2023. Heard Learned counsel, Mr. K.K. Pal appearing on behalf of the petitioner accused and also heard Learned P.P., Mr. R. Datta along with Learned Addl. P.P., Mr. R. Saha appearing on behalf of the State-respondent. At the time of hearing, Learned counsel, Mr. K.K. Pal appearing on behalf of the petitioner accused submitted that earlier this present petitioner preferred one bail application before this High Court and this High Court by order dated 30.04.2025 in (2) A.B.No.33/2025 was pleased to reject his bail application. Although, initially he was granted interim protection and by this time, his wife is suffering from severe Gynecological problem and doctor has advised for surgery. So, Learned counsel urged for releasing the accused on bail in any condition. On the other hand, Learned P.P. submitted that considering the nature and gravity of the offence there is no scope to consider pre-arrest bail of the accused at this stage. I have heard both the sides at length and perused the record. It appears that one Labour Inspector, Sri Anirban Bhowmik on 19.02.2025 laid an FIR against the petitioner with the allegation that one Mr. Biswajit Paul, Addl. Labour Commissioner, Smt. Paramita Majumder, Dy. Labour Commissioner conducted an inquiry and submitted a preliminary report vide dated 19.02.2025 and from the preliminary report it revealed that Sri Ranjan Saha, L.D. Clerk misappropriated and embezzled public money amounting to Rs.1,28,378/- only under ASSP scheme an welfare scheme for unorganized workers by means of forgery of the sanction memo issued by Labour Commissioner, Government of Tripura and inclusion of name of five persons namely Rakhi Saha, Prashanta Saha, Shibajyoti Saha, Raiharan Saha and according to the FIR all the unauthorized persons are/his near relatives and on the basis of the FIR the present case has been registered. I have also seen the report of the IO. The investigation of the case is in progress. The involvement of the accused with the alleged offence cannot be disbelieved because the present petitioner accused forging the public documents committed the (3) offence. From the medical papers submitted it appears that the doctor has suggested for surgery, if required and the documents have been issued by a medical officer not by any specialist and even there is no report of any gynecologist. The conduct of the accused is not at all satisfactory. He did not cooperate with the investigation nor he surrendered before the Court. From the papers submitted it also appears that in earlier occasion also he committed similar nature of offences. So, on the submission of Learned counsel for the petitioner accused I do not find any scope to show any lenient view in his favour by granting him pre-arrest bail. Moreso earlier bail application was rejected after hearing both the sides. But no new grounds could be projected by accused persons at this stage. Accordingly the application for granting pre-arrest bail stands rejected. Return back the CD to IO through Learned P.P. along with a copy of this order.
