Heard Sri Nikhil Pandey, learned counsel for the petitioner, Sri Ashish Chand Nishad, learned standing counsel for the state- respondents and Sri Azad Rai, learned counsel for the respondent- gaon sabha. 2. The instant P.I.L. has been filed for the following relief:- "I. issue, a writ, order or direction in the nature of mandamus commanding/directing the respondent no.2- District Magistrate Prayagraj to remove the encroachment made by the respondent nos.8 and 9 on the public path by which the interlocking work may be conducted by the Gram Pradhan situated at Arazi No.424 in Village Kaneda, Tehsil- Meja, District- Prayagraj." 3. Counsel for the petitioner submitted that the private respondents should be evicted from the plot in question as they are in illegal possession over the same. 4. I have considered the arguments advanced by counsel for the petitioner and perused the records. 5. There is no dispute about the fact that the plot in question is recorded as Class1-A category land in the revenue records in the name of petitioner along with other. 6. The P.I.L. for construction of road and removal of encroachment, Versus Counsel for Petitioner(s) : Nikhil Pandey Counsel for Respondent(s) : Azad Rai, C.S.C. Girja Shankar .....Petitioner(s) State Of U.P. And 8 Others .....Respondent(s) cannot be entertained in respect to the plot which is recorded as class 1-A category land in the current revenue records. 7.
