HON'BLE MR. JUSTICE MANEESH SHARMA Order 23/05/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of the petitioner, who has been arrested in connection with FIR No.37/2024-25 registered at Excise Police Station, Shahpura, District Jaipur for the offence punishable under Sections 16/54 of the Rajasthan Excise Act. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is in custody since 01.05.2025; offence is triable by the Magistrate and there is no previous criminal antecedents of the petitioner and the trial of the case will take considerable time, therefore, further custody of the petitioner would not serve any fruitful purpose, so, petitioner be released on bail. 3. Heard learned counsel for both the parties and perused the material available on record. 5. Considering the fact that accused-petitioner is in judicial custody since 01.05.2025 and the fact that the matter is exclusively triable by Magistrate and trial/investigation of the case may take considerable time, thus, without commenting any opinion on the merits/ demerits of the case, I deem it just and proper to allow this bail application. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner Kamlesh S/o Bholaram shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
