The petitioners who have been charge sheeted for the offences punishable under Sections 467, 468, 471, 416, 417, 420, 34, 419 and 120B of Indian Penal Code, are before this Court seeking relief.
2. The prosecution alleges that the petitioners by forging the signature of the respondent No.2, who is the brother of accused No.1 and 3, submitted a letter with the

Tahasildar concerned for changing the mutation entry in favour of the petitioner No.1.
3. The parties are present before this Court and have filed an application for compounding of offences stating that, they have amicably resolved the dispute among themselves, and respondent No.2 has stated that the signature on the consent letter submitted with the Tahasildar concerned was duly signed by him, and in terms of the settlement, the respondent No.2 has agreed to withdraw the allegation against the petitioners for having forged the signature, and also has no objections for quashing the impugned proceedings.
4. The application is placed on record.
5. Although the offences alleged are cognizable and non-compoundable, considering that the parties have amicably resolved the dispute and the complainant has no objection to quashing the proceedings, continuing the trial would be futile. Given the circumstances, the probability of conviction appears remote and bleak due to the settlement. Therefore, allowing the criminal proceedings to continue would amount to an abuse of the process of law.

6. Accordingly, I pass the following:
ORDER
i. Criminal petition is allowed.
ii. The impugned proceedings in C.C.No.326/2021 on the file of the Senior Civil Judge and JMFC at Nagamangala in Crime No.102/2015, registered by the Nagamangala Police Station, insofar it relates to the petitioners-accused herein is hereby quashed.
