Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for following relief:- "I. Issue a writ order or direction in nature of mandamus declaring the marriage of the petitioner and respondent no.2-Smt. Radhika Yadav void-ab-initio and nullity under section 11 and 12 read with section 5 of the Hindu Marriage Act, 1955." 3. We are of the considered view that the petitioner has adequate remedy to apply for declaration of marriage is void under the relevant provisions of the Hindu Marriage Act, 1955 by instituting case before the family court. 4. In view of the above, we decline to grant indulgence in the matter, however, liberty rests with the petitioner to apply before the family court, if so advised. 5.
