Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 08.09.2025 [1] This matter is taken up as unlisted item on mentioning in supplementary list. [2] Heard Mr. Shakir Khan, learned counsel for the petitioner and Mr. H. Debendra, learned Dy. A.G. assisted by Mr. A. Bheigya, learned Jr. G.A. for the State respondent. [3] By the present petition, the petitioner who is owner of the homestead land under Old Patta No. 195 corresponding to New Patta No. 249 covered by C.S. Dag No. 125 (Sht-1) of Village No. 100 Wangkhem, Tahasil Yairipok, Sub Division Thoubal, Manipur for an area of .0652 hectares approached this Court for staying the eviction and demolition of structure from his homestead land. [4] It is submitted that the revenue authority has marked red colour upon the structure erected within petitioner’s patta land. It is submitted that the eviction and demolition be restrained during the verification process. [5] Mr. H. Debendra, learned Dy. A.G., submits that in the ongoing eviction and demolition drive upon the encroachment of Government land, no one from patta land and no structure within the patta land has been evicted or demolished and the demolition against the encroached area is done after proper verification. [6] Recording the submissions made by the learned Dy. A.G., writ petition is disposed of by directing the respondents that eviction and demolition, if any, from the alleged encroached area be done after proper verification and giving opportunity of being heard to the petitioner. [7] With this observation, writ petition is disposed of. Misc. application is closed.
