HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22611 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J.
HON'BLE SANJIV KUMAR, J. Heard Mr. Abhijit Mishra, learned Counsel for the petitioners at considerable length and Mr. Ghan Shyam Kumar, learned AGA-I. A perusal of the impugned FIR shows that the victim Anuj was assaulted with an iron rod blow to his head that caused him to lose consciousness. Learned AGA has placed before us a supplementary Medical Report, which is a brain scan report, indicating that there is a thin subdural haematoma and an overlying comminuted fracture involving the frontal bone and left parietal bone extending inferiorly to involve the lateral wall of left orbit and extending medially upto the sphenoid sinus. The injury is apparently serious in nature and delivered to a vital part of the body employing a deadly weapon, an iron rod. Prima facie, the contentions that have been advanced by learned Counsel for the petitioners may be his disputed defence, but those must await examination at the trial. We cannot go into them in the present proceedings under Article 226 of the Constitution. This writ petition fails and is summarily dismissed.
