HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22604 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J. HON'BLE SANJIV KUMAR, J. Heard Mr. Dinesh Kumar Yadav, learned Counsel for the petitioners and Mr. Anil Kumar Mishra, learned Additional Government Advocate appearing on behalf of the State. This writ petition has been seeking to quash the proceedings of First Information Report dated 17.09.2025 registered as Case Crime No.324 of 2025, under Sections 115(2), 352, 351(2) B.N.S., Police Station- Nauchandi, District Meerut. There is an allegation of assault against the petitioners. On 17.09.2025 at 09.00 p.m. when the informant had gone to a hotel to eat his dinner, the FIR says that he was abused in filthy and vulgar language and assaulted employing sticks (Dande). It is also said that he received an injury to his head, besides a threat to do him to death. Upon a perusal of the medico-legal report that has been produced by the learned A.G.A, we find that there is a lacerated wound in the left side of the head with multiple red abrasions and on the left side of the face as well as the abdomen. All injuries though, have been opined to be simple in nature and caused by a hard and blunt object, the description of injuries coalesce with the account of assault. This is a matter where we cannot consider the petitioners' disputed defence that he is innocent and has been falsely implicated for whatever reason. Versus Counsel for Petitioner(s) : Dinesh Kumar Yadav Counsel for Respondent(s) : G.A. Mobin And Another .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) In the circumstances, there is no good ground to interfere with the impugned FIR. This petition is summarily dismissed.
