NARASINGH Order No. ORDER 10.03.2025 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.870 of 2024 pending on the file of learned S.D.J.M., Malkangiri arising out of Malkangiri P.S. Case No.713 of 2024 for commission of offences punishable under Sections 420/34 of IPC. 3. The written complaint submitted by the learned counsel for the Petitioner is taken on record. 4. It is submitted by the learned counsel that the Petitioner owed money in respect of the jewellery taken from the shop of the informant and in course of time the Petitioner had admittedly repaid a sum of Rs.19,42,467/- out of Rs.49,48,745/- and for the balance amount, he had issued some cheques which were bounced for which the present FIR has been filed. 5. It is submitted by the learned counsel for the Petitioner that the allegations are basically civil in nature and given it a colour of criminality, the FIR has been instituted and it is stated that the Petitioner has no criminal antecedent. 6. Learned counsel for the State opposes the prayer. 7. Taking into account the nature of allegation and the payment and the issuance of cheques as noted, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper. 8. Before releasing the learned Court shall verify as to whether order of this Court has been assailed before the Apex Court and if so, the result thereof. 9. It is needless to state that the Petitioner shall cooperate with the ongoing investigation. 10. Accordingly, the ABLAPL stands disposed of. (V.
