Case No.5 of 2012 and L.A. Case No.6 of 2012 respectively. M.A. No.211 of 2013 has been preferred against the order passed in Succession Case No.4 of 2012, by which claim for grant of succession certificate has been rejected. These appeals were preferred by Smt. Lakshmi Mishra and Smt. Uma Tivari. On 1st March, 2023, an information was given by conducting counsel, Mr. Pratyush Kumar that Smt. Lakshmi Mishra died on 02.11.2020 and further information was received by this Court by conducting counsel on behalf of appellant no.2- Smt. Uma Tivari that she had also died during the pendency of appeal. No substitution petition or an application for setting aside the abatement order consequent upon the death of the appellants have been filed. It is submitted by learned counsel, Ms. Prerna Jhunjhunwala, associate counsel to Mr. Indrajit Sinha that they have not received any instruction in this matter.
