Abdullah P, learned counsel for the petitioner and Mr. R. Kaushik, learned Addl. Public Prosecutor for the State. By this application, the petitioner has prayed for bail in connection with Jogighopa P.S Case No. 91/2025 under Section 310(4)/319(2)/61(2) of BNS. The FIR dated 31.07.2025 reveals that on a secret information, when the police personnel conducted a naka checking near a particular bridge, they saw a vehicle approaching from Goalpara side to Bongaigaon. They tried to stop the vehicle but the same had turned and fled towards Goalpara. The police thereafter chased the vehicle and intercepted the same and four (4) individuals were found inside the vehicle and one of them being the petitioner and on interrogation, it was found that the petitioner along with others, with the purpose of looting an amount of Rs. 12 Crore from Tura were proceeding for the same. Mr. S.M. Abdullah, learned counsel for the petitioner submits that the allegation against the petitioner is not based on any materials on record. The only allegation against the petitioner is that they were supposed to loot some Page No.# 3/4 amount of money from Tura, for which there is no material on record. He further submits that a fake Identity Card that was obtained from the petitioner was not his and that he is not connected whatsoever with the same. Mr. R. Kaushik, learned Addl. Public Prosecutor by relying upon the Case Diary submits that there are enough materials to the effect that the police personnel have deposed that the petitioner and others were on their way to loot cash from a particular place and for that reason, they were carrying a fake I.D Card. Upon consideration of the submissions made by the counsels as well as the contents of the Case Diary and the FIR, it is noticed that the allegation made against the petitioner and others were on suspicion and that the petitioner has been incarcerated for 56 days as of today. In view of the same, this Court finds it fit that the petitioner may be released on pre arrest bail on furnishing a bail bond of Rs. 20,000/- with one (1) local surety of the like amount to the satisfaction of the SDJM, North Salmara, Abhayapuri under the following conditions:- 1. The petitioner shall cooperate with the investigation and shall appear before the SDJM, North Salmara, Abhayapuri as and when called for. Page No.# 4/4 2. The petitioner shall not tamper with the evidence or influence any of the witnesses. 3. The petitioner shall not leave the jurisdiction of the SDJM, North Salmara, Abhayapuri without prior permission of the said Court. Petition is disposed of. JUDGE Comparing Assistant
