2. This application has been filed under section 483 of the Bharatiya Nagarik
Page No.# 2/3 Suraskha Sanhita, 2023, whereby the accused petitioner namely, Khubiram Singh, has prayed for bail in connection with Noonmati P.S. Case No. 142/2025 under Section 117(2)/118(2)/109(1) of BNS, 2023.
3. The allegation in the FIR lodged by the son of the deceased is that the accused named in the FIR had beaten his father with intention to kill him and left him on the road side and thereafter, ran way by driving his vehicle bearing Regd. No. RJ-14-GK-4771.
4. The learned counsel for the petitioner submits that the petitioner has been detained in custody since 13.08.2025. It is also submitted that in the meantime, charge sheet has been submitted.
5. The case diary has been received. The learned Additional Public Prosecution submits that investigation has revealed incriminating materials against the present petitioner. However, investigation is complete resulting in charge sheet against the accused persons including the present petitioner.
6. The learned counsel for the informant has fairly submitted that he is opposing the bail petition on merits, but undoubtedly the investigation is complete.
7. Despite the adverse materials, considering the period of detention and also completion of investigation, I deem it fit to grant bail to the petitioner, subject to conditions.
8. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Noonmati P.S. Case No. 142/2025 under Section 117(2)/118(2)/109(1) of BNS, 2023, on furnishing bail bond of Rs.30,000/- with one suitable surety of the like amount (preferably from the State of Assam) to the satisfaction of learned concerned court.
9. The direction for bail is further subject to the conditions:
Page No.# 3/3 (a) That the petitioner shall not abscond; (b) That the petitioner shall be available for trial; and (3) That the petitioner shall not hamper or tamper with evidence.
10. Violation or breach of any condition(s) shall entail cancellation of bail.
11. With the above observations, this bail petition stands allowed and
disposed of accordingly.
