This petition has been filed under Section 482 of the Bharatiya Nagarik Page No.# 2/2 Suraksha Sanhita, 2023, whereby the petitioner, namely, Nasiruddin Mondal (Raj) @ Nasir Uddin Mondal, has prayed for granting pre-arrest bail, apprehending arrest in connection with Numaligarh Rural P.S. Case No. 72/2025, under Section 61(2)/308(5) of BNS read with Section 67 of IT Act.. 3. The FIR has been lodged by alleged victim women. The gist of the allegations is that the accused threatened her and thereafter, forced her to communicate with him but subsequently, he recorded some video calls and with threat of making them viral tried to extort money from her. It is also alleged that as she did not pay the money, he already made the video viral. 4. Mr. Chutia, learned Additional Public Prosecutor submits that case diary has been received and investigation has lent support to the said allegations. One pen drive containing improper photo/video of the informant/victim was recovered from him and also investigation has also shown that photograph/video was made viral by the person. 5. It is submitted that the statements of the witnesses lends support to the same. Upon perusing some relevant portions of the case diary, I find force in the contention of the learned Additional P.P. 6. Investigation is not yet completed. In this situation this may not be a appropriate case for granting anticipatory bail. 7. Accordingly this petition is rejected. 8. Returned back the case diary. JUDGE Comparing Assistant
