This petition has been filed under Section 482 of Cr.PC with following relief: “This Hon'ble Court may kindly be pleased to quash the FIR No. 26/2022 registered before Police Station Nandghat, District Bemetara, and all consequential proceedings emanating from crime no.26/2022 against the petitioner including criminal case no. 2158/2022 pending before Judicial Magistrate First Class, Bemetara or any other order that Hon'ble court deems fit to be passed, in the interest of justice” 2. Learned State Counsel submits that complainant has not been made party in this case, further charges have been framed against the petitioner before the trial Court concerned. 4. Learned counsel for the petitioner submits that an application has been moved for bring the complaint as respondent No.4. Though the charges have been framed against the petitioner, but till date no prosecution evidence has been recorded as the complainant has not appeared before the trial Court. However, he contended that petitioner may be permitted to withdraw this petition with liberty to file better constituted petition. 5. Perusal of present petition would show that at the time of filing of this petition i.e, on 06.05.2023, complaint has not been made a party in this case, however, after two years of filing of this petition, an application has been moved by the petitioner on 01.05.2025 for bring the complaint 3 as respondent No.4 along-with subsequent development. 6. In view of above facts, the instant petition is dismissed as withdrawn with liberty as prayed for. 7. Registry is directed to return back certified copies of the order/documents to the counsel for the petitioner, after retaining photocopies of the same on record. CC as per rules.
