IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.10649 of 2025 Date of Decision:04.07.2025 _______________________________________________________ Amrit Lal & another …….Petitioners Versus State of Himachal Pradesh & others … Respondents _______________________________________________________ Coram: Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? 1 For the Petitioner: Ms. Babita Chauhan, Advocate. For the Respondents: Mr. Rajan Kahol and Mr. B.C.Verma, Additional Advocate Generals and Mr. Ravi Chauhan, Deputy Advocate General. ____________________________________________________ Sandeep Sharma, Judge(oral): By way of instant petition, petitioners have prayed for following main relief:- “That the respondents may be ordered to correct provisional seniority list of the Junior Technicians in accordance with rules and the representation of the petitioners, which is placed on record as Annexure P-2, may also be ordered to be disposed of.” 2. Before reply, if any, could be received from the respondents, learned counsel representing the petitioners, while making this Court peruse representation dated 02.01.2025 (Annexure P-2), addressed to Engineer-in-Chief, HPPWD, Nigam Vihar, Shimla, Himachal Pradesh, states that petitioners would be content and 1Whether the reporters of the local papers may be allowed to see the judgment? 2 satisfied in case directions are issued to the competent authority to consider and decide the representation expeditiously. 3. While putting appearance on behalf of the respondents, Mr. Rajan Kahol, learned Additional Advocate General states that he is not averse to aforesaid innocuous prayer made on behalf of the petitioners. 4. Having perused the averments contained in the petition, which is duly supported by an affidavit, this Court finds that precisely the grouse of the petitioners is with regard to seniority list of Junior Technician Grade-II in HP, PWD as on 31.10.2024. As per the petitioners, they have been assigned wrong seniority. Since work charge status was given to the petitioners as Junior Technicians w.e.f. 01.01.2007 instead of 26.11.2008, necessary correction is required to be made in the seniority list. Though, in that regard petitioners have already represented the competent authority, but till date no decision has been taken. 5. Consequently, in view of the above, this Court without going into the merits of the case deems it fit to dispose of the present petition with a direction to the respondents to consider and decide the representation dated 02.01.2025 (Annexure P-2) of the petitioners expeditiously, preferably within a period of two weeks. Ordered accordingly. Needless to say, authority concerned, while doing the 3 needful in terms of instant order, shall afford an opportunity of hearing to the petitioners and pass appropriate order. Pending applications, if any, also stand disposed of. p (Sandeep Sharma), Judge July 04,2025 (shankar)
