HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 36351 of 2025 Court No. - 9 HON'BLE ARUN KUMAR, J.
1. Heard Ms. Manisha Chaturvedi, learned counsel for the petitioner, Sri Ashish Kumar Gupta, holding brief of Sri Pranjal Mehrotra, learned counsel for the respondent no.2 and learned Standing Counsel for the respondent-State. 2. The present writ petition has been filed challenging the order of the respondent no.2 dated 15.5.2025 disposing of Appeal No. S09/A/0484/2025, stating that the required information has already been received by the appellant-petitioner. 3. It is contended by learned counsel for the petitioner that the aforesaid appeal had been filed before the respondent no.2 for not getting the information as required by the petitioner through his application dated 5.3.2024 from the Headmaster, Primary School, Ugapur, Bhadohi. The impugned order dated 15.5.2025 shows that the information sought by application dated 5.3.2024 has been given by the Additional District Judge-Ist, Bhadohi Gyanpur. The two statements in the impugned order run contrary to each other, as no information was sought from the Additional District Judge-Ist, Bhadohi Gyanpur through the application dated 5.3.2024 filed as Annexure-2 to the writ petition. 4. The perusal of the order dated 15.5.2025 shows that the appeal has been disposed of on the statement given by the appellant-petitioner. However, perusal of the record shows that there is no co-relation with the application dated 5.3.2024 with the information provided by the Versus Counsel for Petitioner(s) : Manisha Chaturvedi, Smt. Chandra Kala Chaturvedi Counsel for Respondent(s) : C.S.C., Pranjal Mehrotra Lal Chandra @ Lala Chandra .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s)
Additional District Judge-Ist, Bhadohi Gyanpur, which is filed as Annexure-5 to the writ petition. 5. Be that as it may, the present writ petition is disposed of with liberty to the petitioner to approach the respondent no.2 with an application disclosing the aforesaid facts. If any such application is filed by the petitioner alongwith a certified copy of this order, within 15 days from today, the respondent no.2 shall make all endeavour to reconsider the application and take a fresh decision in appeal, if so required, within a further period of two months, thereafter. The order dated 15.5.2025 passed in appeal shall abide by the subsequent order to be passed by respondent no.2.
