Heard learned counsel for applicant and learned AGA for the State. 2. The application has been filed for quashing the non bailable warrant dated 02.06.2025 as well as entire proceeding of Complaint Case No.27452 of 2022 (Indradevi Vs. Mohd. Ejaj Ahmad) under Section 138 Negotiable Instruments Act, Police Station-Shahpur, District- Gorakhpur pending before the Court of Civil Judge/ Senior Division-l, Gorakhpur. 3. It is submitted by learned counsel for applicant that non bailable warrant has been issued against applicant by order dated 2.6.2025. Learned counsel for applicant submits that till date applicant has not been arrested. It is further submitted that applicant is ready to participate in the trial court proceedings. Learned counsel for applicant submits that earlier bail was granted to the applicant, however, on account of non-appearance of applicant, non bailable warrant has been issued. Learned counsel for applicant submits that applicant would remain present before the court concerned on the next date. 4. Learned AGA has no objection. 5. In view of the submission of learned counsel for applicant, non bailable warrant order dated 2.6.2025 shall remain be kept in abeyance for a period of 30 days. Applicant shall appear before the court concerned within the aforesaid period and shall participate in the trial court proceedings. In the event applicant fails to appear or participate in the Versus Counsel for Applicant(s) : Deepak Kumar Tripathi Counsel for Opposite Party(s) : G.A. Mohd. Ejaj Ahmad .....Applicant(s) State of U.P. and Another .....Opposite Party(s) trial court proceedings, the authority would be at liberty to execute non bailable warrant in accordance with law. 6.
