The instant petition has been filed for mandamus directing the respondent no.1/ Consolidation Officer, Jahanaganj, District- Azamgarh to decide the Proceeding of Case No.95 (Mohd. Shamshad Qureshi and Others vs. Pramila and others), under Section 12 of U.P.C.H. Act within stipulated period. 3. Learned counsel for the petitioner submitted that in pursuance of the order passed by the appellate Court, matter is pending before the Consolidation Officer since 2019. He further submitted that the copy of order sheet of the case has been annexed as Annexure No.2 to the petition in order to demonstrate that the case is not proceeding expeditiously. 4. Without expressing any opinion on merits of the case Versus Counsel for Petitioner(s) : Deepak Singh Yadav Counsel for Respondent(s) : C.S.C. Mohammad Shamshad Qureshi And Another .....Petitioner(s) Consolidation Officer And 8 Others .....Respondent(s) and keeping in view of the facts and circumstances, respondent no.1/ Consolidation Officer is directed to decide the aforementioned case on merits after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order before him. 5.
