Ghosh, Learned counsel appearing for the accused-petitioner. Learned P.P. Mr. R. Datta is present for the State. Seen the petition filed by the applicant. By the order dated 24.01.2025 in Bail Application No.1 of 2025 the accused petitioner Burhan Uddin was granted interim bail till 28.02.2025 with certain terms and conditions. However in the said order through typing mistake in one page it was written that interim bail till 28.05.2025 which should be actually till 28.02.2025. However, it was submitted by the Learned counsel the accused-petitioner on 28.02.2025 appeared before the Learned Trial Court who on his application extended the period of bail for further fifteen days. It was further submitted that the case was pending for examination of one or two witnesses. But no specific date is fixed by the Learned court below to ensure examination of the witnesses and to conclude the trial. Learned P.P. Mr. R. Datta appeared and submitted that the accused may be allowed to remain on bail subject to the satisfaction of the Learned Trial Court and a direction may be given to the Learned Trial Court for early disposal of the case. Page 2 of 2 By the said order dated 24.01.2025 specific direction was given to the Learned Trial Court below to conclude the trial as all the witnesses were examined excepting one or two witnesses. So considering the situation it is ordered that the Learned Trial Court below shall without any confusion treat the date as 28.02.2025 in place of 28.05.2025 clearly mentioned in the said order and the Learned Trial Court also shall consider the further bail application of the said accused person either on interim bail or regular bail modifying conditions, if any. No further application is required to be filed before the High Court for extension of bail. It is further clarified that all efforts should be made by the Learned Trial Court to dispose of the case after examining of the rest witnesses, if any giving top priority for the ends of justice. With this observation, this IA stands disposed of. A copy of this order be communication to the Learned Court below accordingly.
