Heard Sri Anuj Kumar Sharma, learned counsel for the petitioner, Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State-respondents and Sri Achal Singh, learned counsel for the respondent-Gaon Sabha. The present petition has been filed seeking to assail the order dated 24.02.2025 passed by respondent no.2 in Revision No.CZOI907000000357 (Suleman and others Vs. Badaruddin and others), and also the earlier order dated 31.08.2018 passed by respondent no.3 in Case No.02 of 2014-15, in proceedings under Section 116 of the UP Revenue Code, 2006. In the order impugned whereby the revision has been rejected, it has been noted that against the order passed in proceedings under Section 116 of the UP Revenue Code, 2006, the remedy of statutory appeal would be available and that the revision would not lie. It is not disputed that the petitioner was a party in proceedings under Section 116 of the UP Revenue Code, 2006. In this view of the matter, in case the petitioner is aggrieved with the order passed in the aforesaid suit, it would be open to him to Versus Counsel for Petitioner(s) : Anuj Kumar Sharma, Nazia Nafees Counsel for Respondent(s) : Achal Singh, C.S.C. Ishaq Ali .....Petitioner(s) State Of U.P. And 6 Others .....Respondent(s) seek the statutory remedy of appeal. Counsel for the petitioner, at this stage, submits that he does not wish to press the petition and that the petitioner would take recourse to the statutory legal remedy. The petition stands disposed of accordingly. Office to return certified copies of the orders to the counsel for the petitioner after retaining photostat copies thereof.
