Heard Sri Shriprakash Shrivastava, learned counsel for the petitioner and Sri Sanjay Kumar Ray, learned Standing Counsel for the State and Sri M J Akhtar, has filed caveat on behalf of respondent no. 4-Jay Prakash. 2. The instant petition has been filed for following reliefs:- i) a suitable writ, order direction in the nature of mandamus commanding and directing to the respondent no. 2 to decide the Case No. 209/21.06.2023 Computer Case No. 202254054465010102 (Anita Vs. Smt. Chandrawati Devi and others) under Section 12 of the U.P.C.H. Act, 1953, filed on 28.04.2023 regarding mutation of the Gata No. 1672Ka area 0.016 hectare out of 0.88 dicimil situated at Mauza Rampur Gonaha, Tappa Batesara, Tehsil Khadda, District Kushinagar; within stipulated period of time in that regard. ii) any other writ, order or direction as the Hon'ble Court may deem fit and proper in the facts and circumstances of the case. iii) award cost of the writ petition to the petitioner." 3. Learned counsel for the petitioner submitted that proceeding under Section 12 of the U.P.C.H. Act, 1953 is pending before the respondent no. 2- Consolidation Officer, (Antim Abhilekh) Padrauna, Kushi Nagar, since 2023. He further placed the order sheet of the proceedings in order to demonstrate that the matter is not proceeding expeditiously.
