This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.405/2023 registered at Police Station – Balkonagar, ADITI DIWAN KAIWART Digitally signed by ADITI DIWAN KAIWART Date: 2025.04.28 10:22:05 +0530 2 (MCRCA No. 580 of 2025) District- Korba (C.G.) for the offences punishable under Sections 420/34, 467, 468 & 471 of the Indian Penal Code. 2. Prosecution case, in brief, is that the complainant namely, Manglesh Das has lodge a report that on 28.01.2020, the applicant herein along with others have given him assurance of providing a government job and received Rs.7.50 Lacs, but they have neither provided the job nor returned the said amount. The police has registered the offence under Section 420/34 of the IPC and sought to arrest the applicant for the alleged commission of offence, 3. Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in the present case. He would further submit that the applicant is a respected member of the society and his arrest in a false and fabricated case will ruin his reputation. He also submits that the applicant is the sole bread runner of his family and if he gets arrested, his family will suffer. The applicant is ready to abide by all the directions and conditions, which may be imposed by this Court while granting anticipatory bail. Hence, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel appearing for the non- applicant oppose the grant of anticipatory bail to the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 3 (MCRCA No. 580 of 2025) 6. Taking into consideration the facts and circumstances of the case and further considering the fact that there are three criminal antecedents and the applicant seems to be habitual offender, I am not inclined to grant anticipatory bail to the present applicant. Accordingly, the anticipatory bail application of the applicant – Santosh Das Mahant, filed under Section 482 of the BNSS, 2023 involved in Crime No.405/2023 registered at Police Station – Balkonagar, District- Korba (C.G.) for the offences punishable under Sections 420/34, 467, 468 & 471 of the Indian Penal Code, is rejected.
