THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 25581 OF 2016 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the action of the 2nd respondent in not considering the applications submitted by the petitioners for renewal of the license for further period of three years in respect of the 2nd respondent municipal shop room Nos.3, 4, 5, 6 and 8 at Noonepalli Mpl.Shop, Nandyal and shop room Nos.1, 2, 5, 6 and 7 at RF Road, Nandyal and Municipal Vegetable Market Sheds (IDSMT Scheme) at Noonepalli, Nandyal, ACC shed as illegal, arbitrary and violative of principles of natural justice and contrary to the provisions of Sec.277 of A.P.Municipality Act, 1965 and A.P.Municipality Act (Regulation of Receipt and Expenditure) Rules, 1968 and Art 300-A of the Constitution of India and consequently direct the 2nd respondent to consider the renewal applications of the petitioners in respect of the 2nd respondent municipal shop room Nos.3, 4, 5, 6 and 8 at Noonepalli Mpl Shop, Nandyal and shop room Nos.1, 2, 5, 6 and 7 at RF Road, Nandyal and Municipal Vegetable Market Sheds IDSMT Scheme at Noonepalli Nandyal (ACC shed), forthwith pending finalization of the applications the petitioners shall be continued as lessees in the 2nd respondent municipality shop rooms and pass such other orders....”

As the Writ Petition is filed vis-à-vis on extension of lease for a period of 3 years in the year 2016. Therefore, the cause in this Writ Petition does not survive for consideration, in view of changed circumstances and afflux of time. 3. Accordingly, this Writ Petition is closed, leaving it open to the petitioners to pursue their legal remedies in accordance with law, if so advised. No costs.
