THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE H.T. NARENDRA PRASAD ORAL ORDER 1. This writ petition is filed under Article 227 of the Constitution of India, seeking direction to the Trial Court to pass a final order in P & SC No.246/2024, as expeditiously as possible. 2. Petitioner has filed P & SC No.246/2024 before City Civil Judge, Bengaluru under Section 372 of the Indian Succession Act, seeking for grant of Succession Certificate in favour of the petitioner No.1 therein, in respect of the petition schedule property. The petitioners herein have produced the order sheet of the Trial Court wherein it is indicated that on 13.11.2024 arguments of the petitioners have been heard and the matter - 3 - NC: 2025:KHC:16530 WP No. 7773 of 2025 has been adjourned to 29.11.2024 for orders. On 29.11.2024, again it is adjourned to 12.12.2024. On 12.12.2024, the matter has been adjourned to 13.01.2025 and on 13.01.2025, again adjourned to 18.01.2025, for orders. On 18.01.2025, the matter has been adjourned to 31.01.2025, on 31.01.2025 adjourned to 22.02.2025, and again on 22.02.2025, the matter has been adjourned to 19.03.2025 for orders. 3. The present writ petition was posted before this Court on 17.04.2025. Since the Trial Court had already posted the matter on 19.03.2025 for orders, this Court on 17.04.2025 had directed to post this writ petition on 22.04.2025 and accordingly, the matter is posted today. 4. Today when the matter is called, learned counsel for the petitioners submitted that before the Trial Court, on 19.03.2025, the matter had been adjourned to 19.04.2025 for orders. In the meantime, petitioners have moved before this Court by filing this writ petition. The writ petition was posted before this Court on 17.04.2025 and this Court has adjourned the matter to 22.04.2025. - 4 - NC: 2025:KHC:16530 WP No. 7773 of 2025 5. Today, learned counsel for the petitioners further submitted that on 19.04.2025, the counsel submitted 'no further arguments' before the Trial Court and hence, arguments have been concluded before the Trial Court and the matter has been ordered to be posted for today before the Trial Court. 6. In view of the above, without expressing any opinion on the merits of the case, the Trial Court is directed to dispose of the P & SC No.246/2024 as expeditiously as possible but not later than 03.05.2025. 7.
