HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 19667 of 2025 Court No. - 49 HON'BLE AJAY BHANOT, J.
HON'BLE GARIMA PRASHAD, J. Learned AGA contends that the F.I.R. records that the first informant was duped into investing a scheme of a company being run by the petitioners. The said company made a representation to the petitioners that it was running a scheme which offered attractive returns to its investors. This is in the nature of financial business for which proper permission from the competent authority has to be taken. In case such schemes are allowed to run by all and sundry without sanction from the competent authorities, the same may start impacting economy at large. Nothing has been shown from the record that the petitioners had any proper financial plan and resources in place to make good their promise, nor has any permission from the competent statutory authorities brought in the record. A prima facie offence which warrants deep investigation is disclosed from the FIR. Faced with this, Shri Bharat Bhushan Paul, learned counsel for the petitioners submits that the petitioners do not wish to press the relief for quashing of the F.I.R. in the writ petition. The relief sought for quashing of the F.I.R. is accordingly rejected. Learned counsel for the petitioners recasts his relief and submits that the petitioners may be granted liberty to approach the Versus Counsel for Petitioner(s) : Bharat Bhushan Paul Counsel for Respondent(s) : G.A. Suryakant Maurya And Another .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s)
competent court for anticipatory bail and for availing other legal remedies available with them under the law. It is always open to the petitioners to avail legal remedies to protect their liberty under the law. The writ petition is disposed of. Office is directed to return the certified copy of the F.I.R. to Shri Bharat Bhushan Paul, learned counsel for the petitioners.
