Heard learned counsel for the parties and perused the records. 2. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for following relief: "i). Issue a writ, order or direction in the nature of mandamus directing the respondents No. 2 to 4 to evict the private respondents from the land being Gata No. 253 situated at Ganjdundwara Etah Road, Etah of the petitioner and to provide the possession to the petitioner and to take the action against them by lodging the F.I.R. for the offences committed by them in accordance with the provisions contained in Section 317(1), 317(2), 317(3) and 317(4) of BNS-2023 and also protect the life and liberty of the petitioner against the private respondents." 3. In our considered view, the relief is in the nature of injunction arising out of a pure civil dispute which may involve disputed questions of fact and hence, petitioner may avail remedy of civil suit, if so advised. According, we decline to grant indulgence in the matter. 4. Subject to aforesaid liberty, this petition is consigned to records.
