Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 01-09-2025 1) By way of this petition, petitioner has sought following reliefs:- 10.1 To issue a writ in the nature of mandamus directing the respondent authorities to consider the grievance of the petitioner for absorption/promotion to the post of Assistant Grade-III. Digitally signed by AJINKYA PANSARE Date: 2025.09.01 18:03:12 +0530 2 10.2 To issue a writ in the nature of mandamus directing the respondent authorities to consider the representation of the petitioner. 10.3 To award the cost and expenses of this petition. 10.4 To issue any other writ or directions or orders in favor of the Petitioner and against the Respondents upon these facts and in the circumstances of the case in the interest of justice. 2) Learned counsel for the petitioner submits that initially, petitioner was appointed to the post of Driver under respondent-department vide order dated 08.09.2008. He further submits petitioner is having qualification for the post of Assistant Grade-III i.e. Graduation as well as PGDCA. He contends that since petitioner is eligible for absorption/ promotion to the post of Assistant Grade- III, he moved a representation on 20.04.2022 but till date, same has not been decided. He prays for a direction to the respondent authorities to consider and decide his pending representation expeditiously. 3) On the other hand, learned State counsel opposes. 4) Heard. 5) Taking into consideration the limited grievance of the petitioner, this petition is hereby being disposed of reserving liberty in favor of petitioner to make a fresh representation before the Collector, Kabirdham i.e. respondent No. 3 within period of 15 days from today and the authority concerned is directed to consider and decide such representation, if so moved by petitioner, strictly in 3 accordance with law within a further period of 90 days. 6) With the aforesaid direction(s) this petition stands disposed of.
