Page No.# 2/3 Suraksha Sanhita, 2023 has been filed by the petitioner, namely, Sri Dake Thomas, who is apprehending his arrest in connection with Offence No. BG/WL/03 of 2025 under Sections 27/29/50(1)(c) and 51 of the Wildlife Protection Act, 1972. 3. The gist of accusation in this case is that on 16.07.2025, the Forest Beat Officer, Singlijan had filed a report regarding seizure of a JCB vehicle, which was used for clearing jungle inside Borgang Forest Range and thereby, it is also alleged in the said report that the driver of the JCB vehicle fled away with the staff of the Borgang Forest Range approaching the spot. Thereafter, the aforesaid offence has been registered. 4. The learned counsel for the petitioner submits that the petitioner is the original owner of the JCB vehicle, which has been seized in this case. However, he had already sold the said JCB to one Ngurang Tonke. 5. The learned counsel for the petitioner submits that the petitioner is in no way involved in the offence alleged in the said report and he is ready to co-operate in the investigation. 6. On the other hand, the learned counsel appearing on behalf of the Wildlife Department submits that if the petitioner co-operates in the investigation, he do not have any objection to the prayer made by the petitioner in this bail case. 7. Considering the submissions made by the counsel for both sides, this anticipatory bail application is disposed of with a direction to the petitioner to appear before the Forest Beat Officer, Singlijan, Biswanath in connection with the Offence Report No. BG/WL/03 of 2025.
If he does so
Page No.# 3/3 within the stipulated period of time, in the event of his arrest in the aforesaid case, he shall be allowed to go on bail of Rs. 30,000/- with a suitable surety of like amount, subject to the satisfaction of the arresting authority with following conditions that:- (i) the petitioner shall appear before the Forest Beat Officer, Singlijan, Biswanath within 10(ten) days from the date of this order and shall co- operate with the investigation; and (ii) the petitioner shall not directly or indirectly make any inducement, threat or promise to the informant or to any other person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts before the Forest Beat Officer, Singlijan, Biswanath or to any Court. 8.
