C. Sharma, learned Senior Advocate appearing for the petitioner would submit that the petitioner was elected as Councillor in the year 2011 and his tenure got expired in the year 2015. He would further submit that the Chhattisgarh Lok Ayog, Raipur vide order dated 01.06.2013 recommended the State Government to take action against the petitioner according to the provisions of Section 13 (1)(a) & (2) of the Chhattisgarh Municipal Corporation Act, 1956. He would contend that a show cause notice was issued to the petitioner by the Commissioner, Raipur Division, on 30.08.2013. It is submitted by Mr. Sharma that 5 years’ tenure of the petitioner has already been completed. Therefore, the petitioner may be permitted to withdraw this petition with liberty to challenge the order dated 01.06.2013 passed by the Chhattisgarh Lok Ayog, Raipur and a show cause notice, dated 30.08.2013, issued by the Commissioner, Raipur Division, if occasion arises. 2) No objection from the other side. 3) Permission granted. 4) Accordingly, the instant writ petition is dismissed as withdrawn with the liberty as stated above.
