After hearing the matter for quite some time it revealed that the applicant without approaching the trial Court, has filed this application directly before this Court raising a ground of delay in trial. The learned Counsel appearing for the applicant submits that under Article 21 of the Constitution of India, the applicant is having a fundamental right of speedy trial and that has been denied to him, however, he seeks permission to withdraw this application, so Rgd. 2026:BHC-NAG:1399
