Heard Mr. A. Ahmed, learned counsel for the petitioner and also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for the State. 2. By this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, Aber Ali, has prayed for granting pre- arrest bail, apprehending arrest in connection with Mankachar P.S. Case No. 121/2025 under Section 127(2)/65(1)/64(2) (f) BNS, read with Section 4(2)/6(1) of POCSO Act. 3. The case arising out of 30.08.2025, lodged by mother of the victim girl with the allegation that the accused was serving as a teacher in a school taken her to some place and committed rape upon her. 4. Mr. Ahmed, learned counsel for the petitioner submits that as per his instruction, the villagers suspected of her having a relation with the teacher and held a meeting and later she was forced to lodge the FIR. The same find support from her statement before learned JMFC and also in her statement before the police. The learned counsel Mr. J.P. Kachari, appears on behalf of the informant, who has also filed affidavit and submits that the FIR was filed due to pressure from other people. 5. Accordingly, it is provided that in the event of arrest of the petitioner, named above, in connection with Mankachar P.S. Case No. 121/2025 under Section 127(2)/65(1)/64(2) (f) BNS, read with Section 4(2)/6(1) of POCSO Act, he shall be released on furnishing bail bond of Rs.50,000/- with a suitable surety of the like amount, to the satisfaction of the arresting authority. 6.
The direction for pre-arrest bail is subject to the conditions that the
Page No.# 3/3 petitioner: (a) shall render cooperation with the remaining investigation and appear before the I.O. for recording his statement; and (b) shall not disturb the victim of the family. 7. Violation of condition(s) shall entail cancellation of pre-arrest bail. 8. The anticipatory bail application stands allowed and disposed of. 9. Send back the case diary. JUDGE Comparing Assistant
