This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioners namely, Raidhan Das and Harlal Das, have prayed for bail in connection with Khetri P.S. Case No. 76/2025 under Section 140(3) of BNS, 2023. 3. The learned counsel for the petitioners submitted that they were arrested on 18.08.2025 and first remanded on 19.08.2025. 4. Case diary, as called for, has been received, wherein the statement of the alleged victim girl/prosecutrix recorded before the learned JMFC during investigation, is available. In the statement, the victim girl is stated to be 17 years old and also stated that the alleged incident took place about 15 days prior to the statement. In the statement, she has implicated both the accused persons. From the statement, prima facie, elements of sexual assault upon the minor also emerges. 5. In said facts and circumstances and considering the serious nature of the allegation and the incriminating materials, it may not be appropriate to grant bail to the petitioner at this stage.
