HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT TAX No. - 5175 of 2025 Court No. - 3 HON'BLE SAUMITRA DAYAL SINGH, J. HON'BLE INDRAJEET SHUKLA, J. 1. Heard Sri Pranvesh learned counsel for the petitioner, Sri Shri Ram Pandey and Abhinava Krishna Srivastava learned counsel for the respondents and the learned Standing Counsel for the State. 2. At the outset, preliminary objection has been raised by Sri Shri Ram Pandey, Sri Abhinava Krishna Srivastava and the learned Standing Counsel that the order of assessment of water and sewerage tax is appealable. 3. Preliminary objection is well founded. In face of statutory remedy of appeal available, we are not inclined to exercise out discretionary jurisdiction under Article 226 of the Constitution of India. 4. Accordingly, interference claimed is declined. Writ petition is dismissed. However, it is left open to the petitioner to avail statutory remedy in accordance with law. That remedy if availed by the petitioner may be dealt with on its own merits, as expeditiously as possible, preferably within six months from the date of full compliance being made by the petitioner, without being prejudiced by any observation made in this order.
