SOUTH SALMARA DIST. SOUTH SALMARA-MANKACHAR, ASSAM, PIN-783138 VERSUS THE STATE OF ASSAM REP. BY THE PP, ASSAM Advocate for the Petitioner : MR. A Z AHMED, Advocate for the Respondent : PP, ASSAM, BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER 19.09.2025 1. Heard Mr. A. Z. Ahmed, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor. 2. This petition under Section 482 BNSS is filed by the petitioner, Page No.# 2/2 namely, Mohubur Rohman @ Mohobor Ali, apprehending arrest in connection with South Salmara P.S. Case No. 103/2025 registered u/s 189(3)/132/121(2)/109 BNS, 2023. 3. The allegation in the FIR is that the accused persons in a group attacked the police party, obstructed them and also caused assault. 4. Learned counsel for the petitioner submits that the arrested accused has been granted bail placing the said relevant order. 5. Learned Additional Public Prosecutor opposing the bail petition submits that the investigation has implicated all these accused persons including the present petitioner and has stated that he was present and involved in the incident. 6. Despite the bail granted to the co-accused, I find force in the contention of the learned Additional Public prosecutor that pre-arrest bail application stands somehow different footing and in view of the materials pointed out by the prosecution, the instant bail petition stands rejected at this stage. 6. Return the case diary. 7. Accordingly the bail application stands disposed of. JUDGE Comparing Assistant
