Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State. 2. This application under Section 483 of the BNSS, 2023 has been filed by the petitioner namely Bijoy Singh who has been detained behind the bars since Page No.# 2/3 24.08.2025 (for last 32 days) in connection with Bongaigaon PS Case No.220/2025 under Sections 20(b)(ii)(B) of the NDPS Act, 1985. 3. The learned counsel for the petitioner has submitted that the accusation against the petitioner is for possessing 2.69 kilograms of suspected ganja. He submits that, considering the quantity of contraband seized from the petitioner as well as the period of detention already undergone by him, the petitioner may be allowed to go on bail. He further submits that the petitioner is ready to cooperate in the investigation. 4. The learned Additional Public Prosecutor prays for another date for the production of the case diary. 5. I have heard the learned counsel for both sides. Although the prosecution has produced the case diary today, considering the fact that the petitioner has already been detained in custody for the past 32 days, as well as the quantity of contraband seized in this case, this Court is of the considered opinion that if the petitioner cooperates in the investigation, further custodial interrogation may not be necessary. 6. Accordingly, the petitioner is allowed bail on furnishing a bond of Rs. 30,000/- with one surety of like amount, subject to the satisfaction of the learned Special Judge, Bongaigaon, with the following conditions: (i) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts of the case before the Investigating Officer; (ii) That the petitioner shall co-operate in the investigation; Page No.# 3/3 7.
