HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 34792 of 2024 Court No. - 68 HON'BLE ASHUTOSH SRIVASTAVA, J. 1. Heard Shri Avnish Kumar Rai, learned counsel for the applicant, Shri Rajesh Kumar Singh, learned AGA for the State-respondents and perused the record. 2. This bail application under Section 439 Cr. P.C. has been moved on behalf of accused-applicant, Sridhar Varma, seeking enlargement on bail in Case Crime No. 0107 of 2024, under Sections 109 (1), B.N.S. 2023 and 3/25 Arms Act, Police Station Karimuddinpur, District -Ghazipur during the pendency of the trial before the Court below. 3. Learned counsel for the applicant argued that the accused-applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 21.07.2024. The prosecution version as set out in the FIR appears to be improbable in as much as the injured who is alleged to have been shot in the chest ran after the applicant to catch him. It has further been submitted that charge sheet has already been filed against the applicant and charges have also been framed and trial is proceeding. The custodial interrogation is no longer required. He has no criminal antecedent and there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. 4. Learned AGA has vehemently opposed the prayer for bail. 5. Considering all above facts and circumstances, the nature of accusations, severity of the punishment in the case of conviction and nature of supporting Versus Counsel for Applicant(s) : Avnish Kumar Rai, Madan Ji Pandey, Samarath Singh Counsel for Opposite Party(s) : G.A., Kalindra Kumar Rai Sridhar Varma .....Applicant(s) State of U.P. .....Opposite Party(s) evidence, reasonable apprehension of tampering with the witness and prima facie case, but without commenting on merit of case, a case for bail is made out. 6. Accordingly, the bail application is allowed. 7.
