Heard learned counsel for the parties and perused the records. 2. By means of this petition filed under Article 226 of the Constitution, petitioners are aggrieved by a notice issued to them by the Public Works Department for removal of unauthorized encroachment made on public road dated 29th August, 2025. 3. Learned Standing Counsel submits that petitioners may approach authority concerned by moving appropriate application setting up his defence. 4. In view of the above, this petition stands disposed of with a direction to the petitioners to approach the authority, namely, Assistant Engineer, Construction Division-I, Public Works Department, Shahjahanpur within a period of four weeks from today and in the event any such application is made as directed herein above, the authority concerned shall pass a reasoned and speaking order and dispose of the application of the petitioner in accordance with law. 5. Any action pursuant to the notice dated 29th August, 2025 shall be taken by authority concerned only after disposal of application of petitioners.
