Heard Sri Sarvanand Pandey, learned counsel for the petitioner and Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondents. The present petition has been filed seeking a direction to the respondent No. 2, the Sub Divisional Magistrate, Kansya, Tehsil Kansya, District Kushinagar to decide the restoration application dated 02.01.2024 submitted by the petitioners before respondent no.2 seeking recall of the order dated 15.12.2023 and restoration of Case No. 5320 of 2021 expeditiously and within a stipulated time period. Counsel for the petitioner has referred to the 'order sheet' of the case, a copy whereof has been appended to the writ petition to point out that although several dates have been fixed but for some reason or the other, matter has been adjourned. The delay in disposal of the restoration application is stated to be causing hardship to the petitioner. Accordingly, a prayer is made for a direction to the respondent No. 2, the Sub Divisional Magistrate, Kansya, Tehsil Kansya, District Kushinagar, to conclude the proceedings at an early date. Having regard to the aforesaid, the present petition is disposed of with an observation that the respondent No. 2 would make an endeavor to decide the restoration application, which is stated to be pending before it, preferably within a period of three months, without granting any unnecessary adjournments to either of the parties, provided there is no Versus Counsel for Petitioner(s) : Sarvanand Pandey Counsel for Respondent(s) : C.S.C.
