05/ 18.08.2025 Heard learned counsel for the petitioners and learned A.P.P. appearing for the State.

The petitioners are apprehending their arrest in connection with Ketar P.S. Case No. 34 of 2025, registered for the offences under Sections 126(2), 115(2), 109/3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa.

Learned counsel appearing for the petitioners submits that there is property dispute between the parties and there are general and omnibus allegations against the petitioners of assault and the injury is grievous in nature and the same has come in the medical report.

Learned A.P.P. appearing for the State has opposed the prayer and submits that there is allegation of assault and injury is grievous in nature.

Looking into the contents of the FIR, it transpires that the said grievous injury has been caused by one Baban Choudhary and said Baban Choudhary is not the petitioner in the present case and there are

general and omnibus allegation against the petitioners, I am inclined to provide privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa, in connection with Ketar P.S. Case No. 34 of 2025, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
