JUSTICE A. GUNESHWAR SHARMA O R D E R 08-09-2025 [1] Heard Mr. H. Kenajit, learned counsel for the petitioner and Mr. H. Debendra, learned Dy. Advocate General assisted by Mr. A. Bheigya Meitei, learned junior Government counsel for the State respondents. [2] By the present petition, the petitioner who is the owner of homestead land under Patta No. 246/1097 (new) covered by C.S. Dag No. 106/591 measuring an area of 0.17865 acre situated at Village No. 102- Bishnunaha, Thoubal District, approached this Court restraining the State respondents from undertaking any eviction and demolition upon his homestead land. It is stated that recently, the officials of the Revenue Department left black markings upon the structure of the petitioner constructed on his patta land and he has an apprehension that the same will be demolished without being any opportunity of explaining his possession. [3] Mr. H. Debendra, learned Dy. Advocate General for the State respondents, submits that in the present mass drive for eviction and WP(C) No. 702 of 2025 & MC(WP(C)) No. 660 of 2025 demolition of encroachment upon the Government land, such eviction and demolition are done upon proper verification and no one has been evicted from patta land and no structure within the patta land is demolished. [4] Mr. H. Kenajit, learned counsel for the petitioner, submits that the petitioner may be given some time to submit his objection to the markings made by the respondents. [5] Taking into undertaking and submissions made at the Bar, the possession and construction within the patta land of the petitioner are protected. However, any eviction and demolition of the alleged encroached area be done after proper verification and giving an opportunity of being heard to the petitioner. [6] With this observation, the writ petition is disposed of. [7] MC(WP(C)) No. 660 of 2025 is also disposed of.
